"The Forever Rose™ Web Site" means the web site located at the domain name www.TheForeverRose.com and at such other domain names used to identify web sites on which The Forever Rose™ may offer and or facilitate The Forever Rose™ Services.
• Copyright: The entire content included in this site, including but not limited to text, graphics or code is copyrighted as a collective work under the United States and other copyright laws, and is the property of The Forever Rose™ and its licensors. ALL RIGHTS RESERVED. Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with The Forever Rose™ or purchasing The Forever Rose™ products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with The Forever Rose™ or to purchase The Forever Rose™ products. • Trademarks: All trademarks, service marks and trade names of The Forever Rose™ and Enchanted Rose™ used in the site are trademarks or registered trademarks of The Forever Rose.
• Privacy: The Forever Rose™ does not share or distribute your personal information with anybody for any reason....EVER! We will only contact you via the information you provided should there be a problem with your order after it has been placed. It is highly recommended that you monitor your email after you have placed your order in case an issue arises. We do not store your credit card information, we do not even see it. Your order is processed automatically via state of the art secure SSL Encryption. This is to protect you, your identity and your personal information.
• Limitation of Liability: The Forever Rose shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if The Forever Rose has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
• Shipping / Delayed Delivery: Compensation for late delivery is based on our ability to place a claim with the shipping carrier and refunds are limited to amount that can obtained from shipping carriers. If a package is late due to a cause of the shipping carrier, refund will usually be granted. If the cause is outside anyone's control, refund is typically not granted. Shipments that are delayed due to causes beyond the shipping carriers control including, but not limited to: the unavailability or refusal of a person to accept delivery of the shipment, acts of God, natural disasters, war risks, acts of terrorism, acts of public authorities acting with actual or apparent authority, acts or omissions of customs or similar authorities, authority of law, insufficient information provided by a customer, Hazardous Materials packages improperly offered for transport, the application of security regulations imposed by the government, or otherwise applicable to the shipment, riots, strikes or other labor disputes, civil unrest, disruptions in national or local air or ground transportation networks including, disruption or failure of communication and information systems, and adverse weather conditions.
• Typographical Errors: In the event that a Forever Rose™ product is mistakenly listed at an incorrect price, The Forever Rose™ reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. The Forever Rose™ reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, The Forever Rose™ shall issue a credit to your credit card account in the amount of the incorrect price plus additional shipping and handling charges.
• Email Offers and/or Newsletter: By agreeing to these terms and conditions The Forever Rose™ may periodically send you an email notification about new products, promotion, sales and discount coupons. These email are rare and will never occur at intervals of more than twice per calendar month. When and if you receive an email from The Forever Rose™ you will always be given the option to unsubscribe by simply replying to the email.
• Payment Methods: We accept online payments by VISA, MasterCard, Discover, American Express, ShopPay, and PayPal. 
• Out of Stock: Every attempt is made to make sure that out of stock items are noted online as soon as the item is no longer in stock. If for some reason you place an order for an item that is out of stock we will email you to make sure that you are aware of the situation as well as to update you on when your item will be back in stock.
• Returns: We are sure that you will be happy with your purchase. If for some reason you are not satisfied with your purchase, you may return you item(s) within 30 days for a full purchase price refund. This offer does not apply to engraved roses, once a rose is engraved it is no longer returnable for any reason other than a manufacturers defect. Shipping charges can not be refunded. If your order qualified for FREE shipping, the actual shipping charges will be deducted from your refund. All refunds are credited back to the charge card used to make the original purchase. Items must be returned in original packaging within 30 business days from the time you received your order. It is strongly suggested that you insure any returns as we cannot offer a refund on items damaged during return transit without this insurance.
• Satisfaction Guarantee: See "returns" above.
• Damaged in shipping: This is a rare occasion but if your purchase is defective or appears to have been damaged in transit, please contact us immediately at service@theforeverrose.com so that we can have the package inspected. Please retain the shipping box and all packaging materials. Items must be returned in original packaging.
• Notice: The Forever Rose™ may deliver notice to you by means of e-mail, phone or by other reliable method to the information you have provided to us during checkout. We will only contact you if there is a problem with your order.
• Miscellaneous: Your use of this site shall be governed in all respects by the laws of the state of Pennsylvania, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Forever Rose™ products) shall be in the state or federal courts located in the County of Schuylkill, Pennsylvania. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Forever Rose™ products) must be commenced within one (1) year after the claim or cause of action arises. The Forever Rose™ failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. The Forever Rose™ may assign its rights and duties under this Agreement to any party at any time without notice to you.
• Use of Site: Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Forever Rose™ or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
• Participation Disclaimer: The Forever Rose™ does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, The Forever Rose™ is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, The Forever Rose™ reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to The Forever Rose in its sole discretion.
• Indemnification: You agree to indemnify, defend, and hold harmless The Forever Rose™, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
• Warranty Disclaimer: The Forever Rose™ guarantees all products purchased from www.theforeverrose.com website against manufacturing defects for 12 months (one year) from the date of purchase. The original purchase receipt is required to file a warranty claim. This warranty does NOT cover tarnish on any Silver products. This warranty does NOT extend to Forever Rose™ products purchased through one of our vendors, affiliates, dealers, etc.. The Forever Rose™ reserves full rights to examine questionable merchandise and reserves full and exclusive rights to determine validity of any defects. To the fullest extent permissible pursuant to applicable law, The Forever Rose™ disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.

• INTERNATIONAL ORDERS

  Where we ship: We ship to US, Canada, Puerto Rico, UK, Australia and New Zealand. We do reserve the right to refund money and not ship to a country not listed above. International Orders range from $29.95 to $44.95+ per order. Please be sure to select the appropriate shipping option during checkout. The Forever Rose shipping charges do not include any customs fess or taxes. All customs taxes and fees are to be paid by the recipient - please see below.
• International Custom Fees, Import Taxes, Duties and Other Fees: International orders may be subject to customs fees, import taxes, duties, or other fees imposed by your government. The Forever Rose does not charge these fees, and in most cases we have no advance knowledge of or control over the amount of the fees. All such fees are the responsibility of the purchaser and are not included in the shipping charges quoted to you during your purchase, either online or via telephone. Please contact your customs office for information about additional fees that may apply. If you refuse delivery on a package, you are responsible for the return shipping costs, as well as any outstanding duties, fees, tariffs or taxes. The Forever Rose reserves the right to not ship to certain countries at our discretion. We ship to the United States, Canada, United Kingdom, Australia, New Zealand.
• We do not ship to the following countries/regions: GHANA, RUSSIA, The Middle East (except when sending to an APO or other USA military address). The Forever Rose reserves the right to not ship to certain countries and/or regions at our discretion.
• Shipping Times: Here is an estimate of how long it will take for you to receive a Forever Rose from the time that your order ships. We try to ship all orders within 1 business day from the time an order is received. If there is any further delay in shipment, other than an item noted as out of stock on our website, we will contact you of the possible delay.
• Amazon Associates: As an Amazon Associate we earn from qualifying purchases.

APO's- Approx 5-10 business days from the date that your order ships. These orders are always shipped via United States Postal Service.
AUSTRALIA & NEW ZEALAND- Approx 5-7 business days from the date that your order ships. These orders are generally shipped via United States Postal Service.
CANADA - Approx 2-6 business days from the date that your order ships depending on your location in proximity to PA, USA. These orders are generally shipped via USPS.
UK - Approx 4-7 business days from the date that your order ships. These orders are generally shipped via United States Postal Service.
Note: We do not gift wrap international orders due to strict Customs regulations.
